Terms of Service
PLEASE NOTE
By commissioning me, you automatically agree to all terms below! Please read carefully before ordering. My TOS may change anytime, so check back if needed.GENERAL
✧ Commissions are for Personal Use only unless commercial rights are purchased. (Additional fees apply depending on service.)
✧ My artwork may be used for personal display such as profile pictures, banners, posting on Socials with Credit, or printing for yourself, but may not be used for profit without prior agreement.
✧ AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs.
✧ I reserve the right to decline commissions outside my abilities or for subjects I will not draw.
✧ Communication is important. If I do not receive a response within 1 week, I will proceed and deliver the artwork as is.
✧ Major changes are only allowed during the sketch stage. After sketch approval and once I move to lineart or coloring, only 2 minor edits are accepted. Additional minor edits are +$5 each. Please make sure all major feedback is given before approving the sketch.REVISIONS
✧ Revisions are flexible during the sketch phase. You may request multiple changes before approving the sketch.
✧ Once the sketch is approved and I move to lineart or coloring, only minor edits are allowed. Up to 2 minor edits are included at this stage. If you request a major edit during lineart or coloring, it will be charged +$5 per edit.
✧ Any mistakes made by me will always be corrected at no additional cost.DEADLINES AND DELIVERY
✧ Commissions may take up to 1 month depending on complexity, queue, health, school, or personal matters.
✧ I will keep you updated if delays occur.
✧ If you wish to skip the Queue and be Priority, the fee will be $10 USD. You will have to Directly Message me or state in the Request forms that you wish for a Rush Fee.INTELLECTUAL PROPERTY RIGHTS
I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.I may use the artwork to:
✧ Promote myself and my services.
✧ Post on social media and in my portfolio.
✧ Create prints/merchandise (for fanart commissions only).
Exceptions:
If an NDA was purchased, the artwork will not be posted or used for promotional purposes.REFUNDS
✧ I may cancel and refund a commission at any time.
✧ You may cancel before payment is made.
✧ Once payment is received, refunds are not available.
✧ Chargebacks are strictly prohibited.
Filing a chargeback will:
Forfeit your rights to use the artwork.
✧ Place you on a public blacklist (with evidence).
✧ Allow me to resell or reuse the artwork as I see fit.
✧ Result in a formal complaint against you.COMMISSIONER RIGHTS
You may:
✧ Use the artwork for personal purposes only (unless commercial rights are purchased).
✧ Print the art for yourself.
✧ Post it on Social Media with credit to me "@flanyaa".
You may NOT:
✧ Use the artwork commercially without permission.
✧ Commission art/services using my Design/Work.
✧ Claim the artwork as your own or fail to credit me.
✧ Resell or redistribute the artwork.
✧ Modify the artwork without my consent.
✧ Use artwork purchased for Personal Use in merch, streaming, or commercial projects.BLACKLIST POLICY
✧ Breaking these rules may result in a permanent public blacklist (with evidence).
✧ The blacklist may be shared with other artists.
Payment
✧ 100% upfront payment is required after approval, unless discussed otherwise.
✧ Payment must be sent within 24 hours after approval, or the request will be canceled.
✧ If you request that I do not post your commission publicly or include it in my portfolio, a Non-Disclosure Agreement fee of 50% of the base commission price will apply.
✧ A complexity fee of $10 to $100 may apply depending on design details, accessories, props, or overall difficulty.
✧ Commercial rights must be purchased separately. Streamer use is 100% of the base price, merchandise use is 150% of the base price, and the same rates apply even if purchased after the commission is completed.
Special Note for NDAs
✧ My NDA will only be valid for 1 year. After that, I am free to display the work as portfolio.
✧ If you want to extend the NDA, there will be an additional fee of +50% of the base price.
Final Agreement
By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.
